Subject: Profiling

It is unfortunate that Trayvon Martin was shot and killed by Mr. Zimmerman.

I spent over thirty years conducting criminal and white collar investigations. As a criminal investigator, my objective was to recreate the events that were involved in or led up to the commission of a crime.
The possession of the drink and candy simply indicate that Trayvon Martin purchased the items from a store or vendor nearby. Most times we intend to consume or drink them within a short time after purchase. If the liquid refreshments are cool or cold upon police arrival at the scene, it can be assumed that the place of purchase is nearby.

Therefore when Zimmerman told the police that Trayvon was acting suspicious, the items in his possession indicate that he purchased them nearby, and conversations with the store owners would confirm he was at a particular place of purchase, at an approximate time.

Thus we have a timeline, and perhaps the names or descriptions of people who were also making purchases at the store while Trayvon was there. Since some stores have electronic surveillance, there could be a video recording of Trayvon at the store, images of other customers and a recorded time and date displayed on the recording device. It is also conceivable that there may be video surveillance devices (city owned and privately owned) that are in the vicinity of where this incident occurred.

Where there witnesses to the incident have have not come forward? This is always possible because some people may desire not to provide information about what they observed that night. They might view being a witness as troublesome.

Sometimes, police and investigators, will surveillance an area for several nights after an incident has occurred. They are looking to identify vehicles and pedestrians that could have travelled through the area on the night that the incident occurred.

This incident does not appear to be Premeditated Murder or murder in the first degree, because it must be proven or shown that the murder was planned in advance. Of course, when felons commit armed robberies or other high level felony crimes that could result in death, Murder in the First Degree is used or implied. I believe that prosecutors correctly selected Second Degree Murder, because if they can not prove it (the elements of proof for 2nd Degree Murder) in a trial then they would still have the elements of proof mostly likely needed for Third Degree Murder (Manslaughter), which are incidents in which deaths are caused by malicious, warrantless, grievous, or neglectful acts on the part of the criminal.

I feel that the time line…the times when specific things or events occurred…will convict Zimmerman of 2nd Degree Murder. It appears that Zimmerman had no reason to approach Trayvon in the first place. He did not have a mere suspicion to approach or stop Trayvon and his suspicions were based on his personal feelings, which have no standing under the laws of this country. In short, it appears that Mr. Zimmerman wrongfully created, caused, or provoked an incident that caused the wrongful death of Trayvon Martin.
