تعريف ب حالة الطوارئ.. صلاحيات استثنائية.
حزمة تدابير وإجراءات تتخذها سلطات دولة على المستوى الوطني، أو في جزء معين من الحوزة الترابية للدولة، بهدف ضبط الأمن والحفاظ على النظام العام إثر وقوع أحداث استثنائية تُهدد الأمن العام كمظاهرات عارمة، أو أعمال شغب واسعة النطاق، أو هجمات واسعة، أو كوارث أو نحو ذلك.
يتلخص إعلانُ حالة الطوارئ في منح صلاحيات استثنائية للسلطات الإدارية، خاصة الشرطة التي تُخولها حالة الطوارئ المسَّ ببعض الحريات والحقوق الأساسية الفردية والجماعية، كالحق في التنقل وحرية الصحافة وحرية التظاهر والتجمع.
الحريات
تتعدد الإشكالات المتعلقة بإعلان حالة الطوارئ ومنها التخوف من المس بالحريات واتخاذ الوضعية الاستثنائية السائدة ذريعة للتضييق على جهة أو شخص بسبب قناعاته السياسية أو العقدية أو لانتمائه الإثني أو نحو ذلك.
ومرد هذه المخاوف يعود في الأصل إلى أن حالة الطوارئ تُخل بالتوازن الكلاسيكي بين السلط والذي هو الضامن الأساس للحريات. فحالة الطوارئ تضعُ على المحك التوازن الكلاسيكي الهش بين الحريات والأمن.
يمنح قانون الطوارئ سلطات واسعة للشرطة والأجهزة الأمنية، إذ يُمكنها مثلا منع تجمعات وغلق مرافق عمومية ووضع أشخاص رهن الاقامة الجبرية إذا قدَّرت أنَّ حريته ربما تُخلُّ بالأمن العام، كما يُفوض قانون الطوارئ الشرطة صلاحية إجراء مداهمات لمنازل تشتبه بوجود خطر ما فيها.
تناول القانون الدولي حالة الطوارئ من خلال العهد الدولي للحريات المدنية والسياسية، الصادر عام 1966،
