     Foreclosure: The Bank is not your friend

First, note that forty million homeowners are under water in the United States, and also, six million home foreclosures have been executed since 2009.

There has been little or no help from the banks or government, for these homeowners despite their many promises from the banks and the Federal government to help.
What can be done?
This blog attempts to detail what I have learned from reading foreclosure literature across the country and tips I have picked up along the way.

Tip Number One:

Don't assume that the mortgage contract you signed is binding and a legal document because you signed it.
More likely there are numerous fraudulent clauses in that document and you can challenge it on that basis.

So send a letter to bank canceling the mortgage debt on that basis. This is called rescission and is perfectly legal. Keep the letter simple. A sentence or two. Simply state the loan number, your information, your statement of rescission. Do not at this point attempt to state points of law.

The bank must respond in 20 days by going to court to prove it has the legal right to foreclose and that the mortgage document is legal and is not fraudulent; or they must litigate the issue.
