The writ of habeas corpus, usually used to test the legality of a prisoner's detention, has expressly been preserved because it is explicitly mentioned in the United States Constitution (thus, it probably cannot be abolished except by constitutional amendment). In the United States federal courts, the writ is most often used to review the constitutionality of criminal convictions rendered by state courts.
A Writ was performed Attorney James Swank and his staff of investigators to be accepted by the courts. Roger’s story is laid out herein and readers of his story and arrest have an opportunity to decide in a juror’s, attorney’s, or judge’s shoes, the innocence or guilt in this Writ.
When reading the “True Writ”, all references to precedent setting cases, trial evidence, and police document pages are (bracketed) to have all inclusive data remain intact. Readers may want to bypass the bracketed references and numbers and absorb only the statements. Legal experts reading this novel will understand and follow the path of the references.
Excerpt
“You know the MacDonalds that you cleaned last month and the keys were missing, well it was robbed last night and the manager was almost killed. Well she said it was you who did it”, Detective Ford informed.
Roger could see where this was going. He decided to not say that he had gone out on a job because he had gotten there late and his boss was standing there. Joe Ernst would certainly fire him for not doing that job. So immediately, he decided to say that he was home.
“Not me.” It was not me. I was at home all night. You can ask my wife and her sister. We watched TV and then went to bed. My wife asked me to take her to breakfast around 4 AM and we went to Denny’s. You can check with Denny’s because I ordered a fast breakfast and I did not have to pay because they did not bring it in ten minutes.”
“We will check that out, but since this dying woman named you, we have to take you in for questioning.” Detective Ford and the officer patted Roger down, opened his fanny pack, and found a roll of bills and some other loose change. Then they walked him outside and searched his truck.
“You said ‘dying woman’. Is she dead?” asked Roger. “No, she will recover from her injuries, but she thought she was going to die and wrote a note, saying that ‘Roggie from the cleaning company did this’.”
“Roggie, who is Roggie? My name is Roger.”
“Close enough”, the detective came back as he continued to look through Roger’s truck. Finding nothing that could be determined as evidence, Detective Ford locked the truck and placed the keys into the fanny pack.
