Voir Dire

Questions, opinions,
lawyers grille the jurors:
"Number thirteen, what do you think?
Number twenty-three, do you agree?"

'To speak the truth,'
the phrase translates, and yet
when it's time to
present the arguments,
the gloves come off --
somehow that fragile
commodity
has gotten lost amid
the alleys of suggestion
and innuendo.

Why is it they never ask
lawyers to raise their hand and
swear or affirm to tell
the truth, the whole truth, and
nothing but the truth?

A question I have wondered about many times, but it is the way the law is. If you are to defend, then defend you must. If you are to prosecute, then prosecute you must. We have a legal system, not a justice system and this may be at the core...

There is no justice, not really, when there is it's usually an accident or an act of God.

Yes, I've always thought this a tricky one... How do lawyers defend someone they know to be less than innocent?? Not sure I could do it... and then go into court and deliberately try to screw the other side. The system is fraught with difficulty though I think it right and proper that everyone has to be PROVED to be guilty, rather than PROVED to be innocent - which is where I believe our judiciary is different over here. A fundamental question legitimately raised in your lines here, Dallas. Thank you. Kate xx
