Fighting CPS

The purpose of this blog is to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done.
Several things have happened In “Case III ” (Pages 184-194 of Fighting CPS ) since August of 2010.
The hearing in January of 2011 maintained the status quo. I was not able to see T1 at that time but gave her caseworker an unsealed birthday card with a note. I received an email from ES1, the aunt who has had custody of T2 since Aug. 2010, in April of 2011. What follows is most of its contents (identifying information has been removed).
“There was actually a hearing on the 1st of April. The judge was to rule whether T1 will be allowed to come to Kenya for a visit or not and secondly, we had asked for a new independent therapist to move the case forward. The judge privately interviewed T1 on and we don’t know what judgment he will make. I am still very hopeful and positive that he will be able to see the intrigues from the lawyer and the children’s advocates as they are still very against T1 reuniting with her family. Now the argument is that they can not release her to come live with us because of T2. They say T2 is the one who hurt her and that she has been doing so well since T2 left. The therapist also reported that she has post traumatic stress disorder and that if she is allowed to come to Kenya, even to visit for a few days, that she might relapse and it won’t be healthy for her to live with T1. We need a lot of prayers because it is only God who can intervene . . . I did not manage to come to court [Apr. 1] because the kids [she has children of her own in addition to T2] were still in school but I was on the phone throughout the hearing.”
How ironic! The lawyer for the children, who (along with the therapist) initially claimed that both children were afraid to see their mother, is now insisting that it is T2 who is the danger! It seems that T1 has the notion that her aunt has crocodiles and lions living in her house. If the therapist/the lawyer have not put this into T1’s head, they have not tried to correct this misunderstanding either. ES1 and her family live in Kenya’s capital city, in a beautiful modern house and there is no wildlife in sight.
Sometimes in August 2011, after several more delay tactics from the therapist (who couldn’t manage to show up in court) and the lawyer, who is supposed to be advocating for T1’s best interests, they all agreed that ES1 could have unsupervised visits, even overnight with T2. ES1 was able to set up several visits before she returned to Kenya to get all her other children back in school. (T1 was very excited about the visits and she looks forward for more visits).
I was able to provide transportation for her (she does not have a car or international driver’s license while visiting in Houston and must rely on the goodness of friends or a cab for transportation) on one of these visits. T1 was as cheerful a child as I had ever remembered. I was glad to hear from her that her caseworker had actually given her a birthday card I sent in Jan. 2011. She said she still had my note. T1 was wearing sandals that ES1 had given her on their previous visit. Her bright eyes, smiles, hugs for her aunt and holding her aunt’s hand as we walked along didn’t indicate any fears to me. (As an experienced teacher, I can tell when a child’s smiles and hugs seem genuine rather than awkward or simply polite.)
ESI doesn’t know then the next court hearing will be but she hopes she will be able to attend. If she is not able her lawyer will represent her, and hopefully, she will have phone contact again. Has the court, the lawyer who is supposed to advocate for the best interests of the children, CPS , or anyone on that “side” had any consideration for the thousands of dollars ES1 has spent on travel, lawyers, or the time she has spent separated from her own children and husband in order to reunite T1 with her family?
Whatever your religious persuasion, please pray for this family.
