The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. Good News/ Bad News
A couple of stories from the Houston Chronicle recently are noteworthy and may be of interest to you, my “Fighting CPS” Blog Readers.
“Good News” first:
In the Feb. 24 and Mar. 10, 2014 posts, I summarized a case reported by one of my favorite Houston Chronicle columnists, Lisa Falkenberg. The case was about “Angela”, a young teen mother (whose pregnancy was the result of sexual abuse by her mother’s “boyfriend.”) On Pg. B1 and 5 of the Houston Chronicle, Oct. 12, 2014, Falkenberg reported that the young girl had been adopted by her foster parents who had stood by her as she fought to keep custody of her baby.
In the same courtroom where her rights had been trampled several months earlier by Judge Philips—Harris County Family Court judge who was finally asked to step down from the case—visiting Judge Eric Andell finalized the adoption and complimented the young mother on her perseverance. “Angela’s” adoptive parents had taken her in when “the system” was ready to throw her away. She is 14 now, still in school, making very good grades, and continuing to be, with adoptive parent support, the good mother she wanted to be all along—in spite of the abuse of which she was the victim.
A huge thanks to the people who made this happen: the foster/adoptive parents; defense lawyers, and others behind the scenes who really believed in Angela and what was best for her child in spite of everyone else; and especially those with the courage to stand up to a “bully” judge.
Too bad such good news is so rare.
Bad News
CPS in San Antonio, TX botched a case with the result that a child died. (Houston Chronicle Oct. 26, 2014, pg. B-5) The reported case went back to a child who, as a result of neglect, died of untreated appendicitis back in 2009. A recent report found that four caseworkers involved failed to protect this child and there were obvious missteps by managers and others. Apparently, a school nurse and a counselor had tried to speak up for the child 48 hours before her death, but CPS wasn’t listening.
The whole report is much more complicated than this blog space would ever allow for, but the point is: CPS is still out there messing up the lives of families either by not acting when they should, or removing a child when there was no need.
The one hope here is that State Senator Carlos Uresti is upset enough that he is planning to introduce a bill in the upcoming Texas legislative session (Jan. 2015) which would target problems in Child Protective Services that “may have played a role” in the 8 year-old’s death.
This writer hopes he succeeds.
