The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. The Houston Chronicle has been running a series of investigative articles on Child Protective Services during the last month or so. The second in the series ran on Sep. 27, 2019, on the front page of the paper. The overall thrust of the series is to expose problems with doctors who are part of a small but growing subspecialty of pediatricians who are supposedly especially trained to be able to spot child abuse. It has come to light that in many circumstances, these “specialists” err, and report as child abusers parents who are actually innocent. (Gee, doesn’t that sound familiar to me and our family?) The entire first segment of the series described the case of a family nearly bankrupted by the cost of proving their innocence.
The second part of the series (Sep. 27 report) focused on the doctors themselves and the fact that many state in their reports, “This is child abuse,” rather than the fact that they have a concern that it might be child abuse. The way they word their reports weighs heavily with family court judges, who tend to rubber stamp CPS recommendations to remove children from parents.
The authors of the series also report that in the State of Texas, these doctors are state funded to the tune of $5 million a year, with $2.5 million of that going directly to CPS! This begs the question: if the state/CPS is paying you as a doctor, what are you more likely to report? This isn’t to say that these doctors haven’t saved some children’s lives—they have. But they make enough errors, “indicting” innocent parents, that lawmakers in Texas have taken notice and hope to act.
Rep. James Frank of Wichita Falls, TX, stated in the article, “I’m very concerned with the premature, unnecessary removal of children, and I think it happens a lot more than people understand.” (Yup! He’s right.)
He is calling for a series of legislative hearings in the coming months to explore how the state can improve on this. Hopefully, as called for by some, parents will have the right to ask for a second opinion and be able to present that second doctor’s report to a judge before children can be removed from their parents.
Since our family had actual experience with a doctor who jumped to a conclusion and ignored other medical evidence that a case did NOT involve abuse, I certainly hope this happens so parents won’t lose their children as often.
