The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. California Mom Fighting Back After She Was Arrested for Letting 4-Year-Old Son Play 120 Feet from Home within Gated Community
A self-described "free-range" mom who allowed her 4-year-old son to play alone on a playground 120 feet from their front door within their gated apartment complex is fighting back after she was arrested for felony child endangerment and neglect.
"We have a CPS [Child Protective Service] case now and every time he's not in my visual site we're in violation," mom Sonya Hendren told KTXL.
A neighbor spotted Hendren's son, Tomahawk, playing in a playground in the family's gated Sacramento, California, apartment complex and reported her to Child Protective Services.
"I thought she would just get a warning and she wouldn't let [him] be out alone again," neighbor Sonja Horrell told KTXL, adding that she didn't mean any harm.
Tomahawk was taken away following the incident. She has since regained custody of her son, but their situation continues to be monitored by CPS.
Her charges have since been reduced to misdemeanors and Hendren continues to fight to get them dropped. The 37-year-old feels she's being targeted for her "free-range" parenting style. . . .
Hendren has been fighting to get the charges dropped for several months, and recently rejected a plea deal of 30 days in jail. Her attorney says if the prosecution is to proceed they must prove his client willfully put her son in danger.
"If this happened 20 years ago, we wouldn't be here," he said. "There wouldn't be a criminal case filed."
DF: The comments and arguments after the article had as much, or as little, commonsense as the incident itself. The following comment made the most sense and to which I might add AMEN!:

People need to realize that when you call CPS on someone it's not a small thing. It's not a matter of someone coming to say 'you shouldn't do that, have a nice day'. It can cost a fortune, put their kids in danger in the foster system, and they can lose their jobs, homes, and families trying to get it sorted out. How does that HELP a family or a child? THINK before you make that call! If this nosy neighbor had a problem, she should have gone across the street and talked to the other about it. At the LEAST warn her that she might call CPS in the future if she sees the child alone. Give her the opportunity to at least explain her point of view and all may well NOT be what it appears to YOU. Do not destroy a family by calling CPS unless you know 100% for certain a child has been abused and is in imminent danger of some kind. A kid outside playing is not any of those things. Saying she thought they'd just get a warning and stop letting him play outside is NOT justification and does NOT take away her responsibility in harming this family for no reason. My cousin made a joke comment that was overheard and landed herself in foster care, raped and abused IN foster care and it cost her dad 7,000 he didn't have to get her back and nearly lost his job for all the time he had to take off for parenting classes for a whole year which he also had to pay a lot for. She was never the same after that. It never should have happened. PLEASE THINK and communicate with the family before you call CPS on ANYONE. You probably do NOT know the facts.
