The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. Another Family Involved in an On-going Ordeal
This story came to me as a result of a conversation at a recent book event. The mother involved asked that I not use her name or location since, technically, the case is not closed. Her words say it better than mine could. It’s another baseless case of CPS wasting time and resources on a family with no problems:
Our ordeal started July 10, 2014. The child involved was our 17 year old daughter.
We were accused of: 1. being negligent parents (evidently because we put her on a train to go to camp. Church members picked her up at the end of the line and drove her to camp and were with her every step of the way, plus phone records show her and my husband in almost constant contact the whole time she was on the train) 2. beating our daughter regularly, but not our other two children because our daughter had evidently lived with my parents at some point and had been returned my mother died and that she had messed up our lives by coming back home to live with us (most of this describes a cousin. Our daughter has never lived anywhere but with us). and 3) I (her mother) had beat her so badly within the last six months that I broke her ribs. 4. We made our daughter work ridiculously long hours with no breaks. 5. made her rise very early to milk goats and do chores before school.
The trigger for the investigation seemed to be bruises on my daughter and a "cry for help". My daughter swears she did no such thing. My daughter is a second degree black belt in a program that teaches all ages. She has been trained to watch for the signs of abuse, she knew exactly what they were trying to do. However, when she tried to defend her bruises (many of which she was very proud of acquiring since it required taking down someone much bigger than herself), when she tried to tell them she is also a level one Krav Maga instructor, plays on the basketball and volleyballs teams, and rides horses, she was told "She did not look like the athletic type" and "Defending them [she guessed they meant her parents] only made the situation look worse".
We did not have a lawyer. We were interviewed for 3 hours both together and separately with our pastor present. The only discrepancy the agent could find in our stories (including on disciplining the children) was that I said he [her husband] came up with putting our daughter on the train and he said I did (in point of fact, it may have been our daughter who saw it as a grand adventure). The agent took pictures of our other children, went through the house, asked about our weapons, and took pictures of our daughter's bedroom. When up there he asked if we wanted him to give an assessment of our daughter because he was trained to see things parents weren't. Our basic response was ‘go for it’ at the end of five minutes he shrugged and said, "Besides some of her anime drawings being a little risk I have nothing." The agent repeatedly told us he could not figure out why he was at our place and it seemed like my daughter had an ideal life.
We when asked about our daughter and the status of the case, he would only say that would depend on the interview with my daughter that afternoon. He left with nothing resolved.
7/13/14 my husband drove down to the camp, picked up my daughter. We have heard nothing from CPS again. The agent said we would get some paperwork in the mail to get our case deleted from the database in [state’s capitol] we have received nothing.
[Hopefully, this family will not be harassed anymore and will receive official word that the case has been closed and not given that “unfounded” label that may haunt them later.]
