The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. This is PART 2 of a story from Eddie Eskew and his family in West Virginia who are currently fighting for their children and their lives with CPS in that state. It shows how a wonderful family can be torn apart by false accusations. Their story demonstrates once again that the system creates as many new victims as it manages to “save.” It also demonstrates the need to NOT say anything without having a lawyer, even when you feel you are in the right. I continue in Eddie’s own words from an email he sent to me in mid-August, 2016:
I pulled out of the driveway and headed for the softball field which was a couple of miles away. Then, as I was driving by the fire department, I saw Nick sitting on the sidewalk with a bunch of people surrounding him. I hurried to the softball field and picked up Trinity and explained to her what had happened as we headed back to the fire department.
When we arrived, Trinity and I both got out of the car and started to walk towards Nick. I stopped when one of the EMT's held his hand out and asked who I was. As Trinity clung to me, I told him that Nick was my kid and asked what was going on. The EMT then asked me if I was his father, to which I replied, yes. Then he told me to back off and get in my car. I did exactly what he said. Trinity and I got back in the car where I immediately called Amber and told her what had happened. Then I saw a city policeman pull up and walk over to Nick. He was there for a few minutes then he came over to my car and asked me to step out. He told me to turn around and spread my legs. Then he handcuffed me, squeezing the cuffs tight enough to cut my wrists and started to take me into the police station, which is right beside the fire department. I asked what was going to happen to Trinity and he said, “Don't worry about her.”
The officer took me inside the police station where he cuffed me to the wall in a small room with a camera in the corner and left me for a while. Later another officer in civilian clothes came in and started questioning me about how much I had drunk. I told him one beer and he uncuffed me and proceeded to give me a field sobriety test. He waved a pen in front of my face for about five minutes, then he told me to stand straight up with my feet together with my hands to my side, then stick one of my feet out, balance myself and count one-one-thousand, two-one-thousand, to as high as I could go. I got up to thirty-one-thousand before my ankle started to hurt and I let my foot touch the ground. He told me that was enough then took me out into the hall and had me walk a straight line heal to toe approximately 10 feet long and back. I did that perfectly then he told me to go back into the room where he cuffed me to the same wall as before. He left the room for a while, then returned with another uniformed officer who had a breathalyzer. They told me to blow into it, which I did then they left the room. They were gone for about 20 minutes when the officer in civilian clothes returned and said he was thinking about charging me with a DUI and that my BAC was .073 (which is under the legal limit of .08). He then left again for about 10 minutes before returning and telling me that he had decided not to charge me with a DUI after all. That was the last time I saw him and I sat there for another 30 minutes or so until the chief of police came in.
The chief asked me a bunch of questions about what had happened, and I told him I had no idea what was going on. Then he proceeded to tell me that my son had a broken nose and a fractured skull. I was shocked to hear this and asked how that could have happened. He told me that was what he was trying to find out. He then started asking me questions about my marriage and suggested that I would cover for my wife because we had been married so long. I told him there was no way on Earth my wife could have hurt Nick. I told him that I had seen them wrestle numerous times around the house and Nick would always get the better of her because they were the same size and weight and he was one of the top wrestlers in the state. He listened and then told me that he didn't think she could hurt him either and that's why he thought it would take someone of my size to hurt Nick that bad. At some point during this conversation the chief told me that I had not been Mirandized and anything I told him could not be used against me in court. I never thought to call a lawyer because I was never told I was under arrest and I was never read my Miranda rights, so I told him everything he wanted to know. I told him he was mistaken if he thought I hurt my own kid because I had never hurt any of my kids. He listened to my story and left. Then a little while later he returned with another uniformed officer to take pictures of my hands to see if there were any cuts or bruises that would indicate that I had hit my kid. There were no bruises or marks of any kind on my hands. The only thing they could find were cuts on my right wrist. They got all excited and asked me where those came from and I said, "Are you kidding me? That's where the handcuffs were over applied to me.” I couldn't help but laugh at that point. I thought this was turning into a circus and little did I know how close to the truth that was.
Finally after three hours of interrogation, they took me out of the room into the hallway where my wife was standing, cuffed and in pajama pants and one of my t-shirts. They had arrested her and wouldn't even let her put on a bra or any underwear. I found out later that they had gone to our house and got her and brought her back to the police station and also gave her a breathalyzer test. I was confused because I didn't understand when drinking in your own home would warrant that test. Anyway, they put us both in a police car where we immediately fell asleep. We thought since we were never told we were arrested, or read our rights, they were going to take us home, but we woke up a couple hours later in front of South Central Regional Jail where we were booked and kept for 18 hours, which was another nightmare altogether.
The story got worse and worse after this, as the lives of our eight children, both of us and our parents, and, recently, the life of an old friend that I was set to donate a kidney to were, delivered into the hands of CPS, one of the most incompetent organizations the government has to offer.
This is just the beginning. CPS has lied to us and tried everything they can to show that we are unfit parents but they have failed in everything so far. We were a very good family with the exception of Nick, who constantly got in trouble wherever he was. He was even admitted to a mental hospital one month before he made accusations against us, but they will not allow us to say that he is the problem. They told us it's a family problem and he can come back home as soon as they "fix" our family.
Thank you for reading this and I hope it helps someone out there someday because being separated from our children is by far the worst part of our lives to date. I would not wish this pain on anyone.
