The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. Just When Something Might Have a Chance:

A federal judge ordered an overhaul of the Texas Foster Care System calling it “broken” and unconstitutional, but Texas Attorney General Ken Paxton has decided to fight that court order. Paxton has filed an appeal with the Fifth Circuit Court of Appeals in New Orleans. He also asked the judge to delay the order while the appeal is heard. A group called Children’s Rights had originally filed the suit against the state of Texas in Corpus Christy because some 12,000 children are in “permanent” foster care. The children’s group is based in New York and alleges that the State of Texas has violated the rights of children by moving them around too frequently, failing to hire enough case workers, placing them in unsafe care and keeping them there too long, and not properly investigating homes.
Judge Janis Graham ruled in the group’s favor and issued a “scathing” 255 page order that stated: children “almost uniformly leave state custody more damaged than when they entered.” The judge ordered the state to: improve caseworker turnover rates, enact new policies that allow children to speak to a caseworker privately, better track child-on-child abuse, and stop placing long-term children in unsafe environments. The order also calls for a special court-appointed master to craft and implement more reforms.
Paul Yetter, lead attorney for the group, called Paxton’s move “disappointing but sadly predictable.” He further stated that the state needs to stop fighting and start fixing. “This system is broken and children are being hurt.”
THIS AUTHOR’S TAKE: GO, Paul Yetter and Children’s Rights! Ken Paxton, get out of the way—you are wasting tax-payer money fighting on the wrong side. Let that money go to children and families instead, where it might do some good. Foster Care in Texas, and the entire Child Protective Services system has been messed up for a VERY LONG time.
ADDED NOTE: a report in the Houston Chronicle on Mar. 16, 2016, stated that the judge had appointed two “special masters” to oversee the overhaul: Kevin Ryan and Francis McGovern. Readers may check out the details in the City/State section of the Mar. 16 issue of the Houston Chronicle.
AND SINCE THEN: at the state level, yet another new “head over all” the foster care system has been appointed. The last two or three accomplished nothing. Sadly, the more things “change”, the more they stay the same.
