The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. It was encouraging to see lawmakers put their infighting aside last week and finally approve an emergency request to hire more than 800 new workers and grant $12,000 pay raises at the beleaguered Texas Child Protective Services.
Vulnerable children in this state - hundreds of them at risk of serious injury or death - could wait no longer. They need help now.
But these long-overdue short-term steps are just a start. State officials on both sides of the political aisle agree that a top-to-bottom overhaul of this chaotic agency has long been in order.
That's why it's difficult to understand why the state's GOP leaders continue their stubborn insistence on appealing a federal judge's ruling to improve it.
The Dallas Morning News' Robert T. Garrett reports that the state has spent $7 million taxpayer dollars fighting the class-action lawsuit over foster care over the last five years. And the meter is still running.
That money would be so much better used protecting kids - particularly in a state that spends less than half the national average on child protection and foster care. The system has been underfunded for decades.
Texas has been under intense scrutiny to fix its system since Judge Janis Graham Jack ruled last year that the state has such a drastic shortage of caseworkers and foster homes, and has been so lax at policing its foster-care vendors, that children are at grave risk.
Texas has violated the 14th Amendment of 12,000 children to be free of harm, she ruled.
Still, Gov. Greg Abbott and Attorney General Ken Paxton insist that state can fix its foster-care system on its own, free of judicial interference.
Color us skeptical. The GOP has controlled state government for the last 14 years and the disregard for troubled children has only worsened during that time. Hundreds of children have died of abuse or neglect in this state.
This newspaper has been calling for improvements for years. Meanwhile, caseworkers have left the department in droves, citing heavy caseloads and low pay.
And The News has reported this year that widespread failures by CPS to check swiftly check on tens of thousands of children at risk of abuse of neglect. About 1 in 5 hadn't been seen at all.
"Given that innocent children's lives are at stake, the state should be focused on fixing its broken system, not spending millions to defend it," noted Paul Yetter of Houston, the plaintiff's lead attorney.
He's right.
We're all for local control. Texas' Child Protective Services chief Henry "Hank" Whitman's $144.7 million emergency plan is a good start on quick fixes.
But if there was ever a time when the state needed to accept federal help, this is it.
Texas should settle this suit and work with the two federal-appointed masters on a comprehensive action plan for long-term meaningful fixes to this system. The state's vulnerable children deserve it.

We need your voice in Austin, so please join us for our biennial Home Visiting and Child Protection Day at the Capitol. We'll assist you in setting up legislative visits and then we'll have a rally on the south steps of the Capitol and make our voices heard on behalf of children with no voice.
Constituent issues resonate more effectively with legislators than any other advocates. The children of Texas need you in Austin, making sure every representative and senator knows that child protection is an issue in your hometown and should be an emergency item.
