The purpose of this blog is to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. This case came to me through the email provided on this blog. This woman has also been in contact with Cheryl Carlson, a frequent provider of information to this blog. It is another example of injustice with children in the State of Florida. I chose to leave it pretty much as she gave it to me:
“In the case of: Tabian Haley, Rayna Thomas, Tobias Thomas, Layla Thomas, Brian Clements, Cora Shelton
“No case number has been provided to me at this time.
“My husband Jeffery Shelton and I attended a dependency shelter hearing on April 4, 2014 in regards to the removal and placement of our six children. I was not given a copy of the dependency shelter petition before attending court, nor was I made aware that it existed. At the time of court, we were the first parents to have a hearing and I had no time to go over this document that I was given as I walked into the courtroom and up to sit in front of the judge. I was told I could obtain legal counsel by the judge during the hearing, but was not advised by any legal counsel during the hearing, nor told that I had any rights- including the right to dispute facts on this document. I do dispute several facts on this document and the facts are arranged in alpha order corresponding to the original Dependency Shelter Petition.
A) Jeffery Shelton and myself had a verbal argument on April 07, 2014. Our child, Tobias, received an injury at that time. Our minor children Tabian and Rayna were not present at that time and were not in imminent danger. Our children Layla, Brian, and Cora were present, in the kitchen, and were not in imminent danger.
B) Jeffery Shelton and I were involved in a verbal dispute after my children came home from school and were engaged in a physical fight over snack time choices. We were upset with each other and went to the privacy of our bedroom to continue our dispute, which did get loud at one point. Our son Tobias did overhear and ran into the room and became injured as a result of hitting his head on the dresser. I agree that his eye was red and swollen.
C) The children listed were present in the home at the time of the verbal dispute. The point states that all six of our children are aware of domestic violence in our home. This is inaccurate as there is not an issue of violence in our home and our children have only seen one other argument between my husband and me [which was in] 2011. At that time, two children were not in my home, one was a toddler, and one was an infant.
D) Jeffery Shelton was arrested, not for child abuse, but was charged with alleged neglect. He does in fact have a bond amount.
E) This states that I downplayed the “serious[ness]” of the domestic violence incident when in fact, I gave a detailed account to CPI investigator Gross in regards to both the verbal argument and how my son was accidentally injured.
F) In 2011, there was a domestic violence injunction filed. This was when I was prescribed medication for anxiety issues I was having due to working more than 40 hours per week in accounting and parenting six wonderful but very active children. My body had a horrible reaction to one of the medications prescribed and I had no control over my actions. My husband was concerned for the safety of our children and attempted to remove them when I contacted authorities. I was under a doctor’s care at that time and before the incident occurred. Dr. Henry Doenlen confirmed that this medication was the factor that caused this incident and that I had no control over the situation at that time in a detailed report that he provided to the court, which caused the case to be dropped. I was told by legal counsel that I was not required at any further hearings, as the case was being dropped.
G) This states that I suffer from bipolar disorder and scizophrenia. I have not been diagnosed with schizophrenia. I have been diagnosed with bipolar disorder and attended cognitive behavior therapy with Dr. Doenlen for almost three years. It is well documented that my body has had horrible reactions to several different medications but that I respond very well to therapy. CPI Gross was not familiar with bipolar disorder and noted that I showed little emotion when my children were being removed. The symptoms of my bipolar disorder are actually manic, not depressive, and when I experience symptoms, I am usually overly happy and excited, not reserved or depressed. I was not asked to sign a medical release at the time of interview for myself, only my children, so my medical history has not been reviewed by the department. I showed no emotion during the removal to prevent my children from being more upset. CPI Gross thanked me for being so calm and polite and explained she was nervous about how I would react during the removal. After that, I was mindful of making a woman who was in the process of taking my children from me more alarmed than she had already told me she was.
H) All parent info, including phone number and city was given for Sean Torneo at the time of the removal.
I) I did inform Ms. Gross that Nicholas Thomas was living in Panama City and that we divorced due to drug issues. We have not been together for 10 years so I cannot speak to his status now in regards to drug addiction.
J) This statement is correct.
“A major issue with the investigation that was not addressed in the information submitted to the court is that Kamri “Leanna” Thomas, a department employee, is the sister of my ex-husband and is living in the home where three of our children were placed. Ms. Thomas has been actively updating my children and questioning them about this case. They have expressed fear over statements she has made in regards to me never regaining custody of my children. Ms. Thomas and I have a volatile relationship. While married to her brother, during the divorce, and after, we have had numerous verbal altercations. As late as last week she contacted me via Facebook message with the intent of verbally abusing me. I called her mother Betty, who is currently the guardian of three of my children and I was told by her that “Leanna is bipolar. Don’t return her calls or messages.” On April 9, 2014 Ms. Thomas was allowed to pick up my child Tabian from her foster home because the foster [parents]wanted to go to dinner and needed a sitter. Ms. Thomas drove my child to her own home and stayed with her through the duration of her time there. Tabian was in the home from approximately 4PM to 9PM. During this time, the case was discussed and Tabian was questioned.
“My children are living with a department worker who has a personal vendetta against me and also has an interest in keeping my children away from me permanently, as her parents have maintained in the past that they wanted to adopt my son Tobias. It cannot be proven that this investigation has not been affected by the biases of Ms. Thomas or that it had not been compromised before CPI worker Gross ever visited my residence. In fact, this gives an explanation as to why my children were removed from my care without speaking to five of my six children, accessing my medical history to be reviewed before grossly inaccurate statements were made, or why the children were first removed from the home before being questioned at the department headquarters for over three hours while being questioned and drilled under duress awaiting placement. Any information that was maintained as a result of the removal should not be admissible as it was obtained in an unsavory manner in a case that may have been compromised from the beginning.
I have not been charged with any crime. I have never been charged with any crimes against children or otherwise. This case is biased and has been compromised. It has affected the legal rights of both my husband and myself. The children were taken out of my care prematurely and without proper inquiry or proof. I believe this has affected my right to a fair hearing.
Because the children were removed in this manner, I believe my rights have been violated and will continue to be violated by this department while my children are away from me and living with a department employee. They were taken with not even an accusation of abuse inflicted by me and should be returned to my custody.”
This case is another example of the courts listening only to what Child Protective Services has to say and taking their word for everything when a complete investigation has not been done and the parent “losing” children has not been able to prepare a proper defense. This is the kind of CPS bullying, with complicit courts. It must be stopped by new legislation in EVERY state.
