The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. A Pierce County couple is fighting for custody of their own child, after they say Child Protective Services took their son with little explanation.
This isn't the first time young Bubby Everson has made headlines. KING 5 first met the 9-year-old with special needs when his family launched an online campaign called 'Birthday Cards to Bubby', because he loves getting mail.
The response was huge. In fact, even President Obama sent Bubby a card.
"It was amazing," said Bubby's dad, Thomas Everson. "We were opening mail every day, and he was happy."
That was back in February, and thousands of cards continue to arrive every week. Now, the Eversons fear the mail may be the very reason Bubby was taken from their home.
On May 22nd, a knock on the door changed everything.
"Two police officers knocked on the door," said Brandi Everson. "Then three social workers came in. They handed me a piece of paper and said we have an order to take your child. I fell to my knees."
Four days later, the Eversons are still struggling to understand what happened.
The two-page order they were given says there is a "risk of imminent harm" to Bubby if he stayed in the home, but no details are given as to why CPS workers felt the home was unsafe.
Brandi Everson was given just a few minutes to pack a bag for her son and then say goodbye to him.
"I said, ‘Mommy loves you very much and I'll see you soon,’" she said, crying.
The Eversons say a CPS investigator first paid them a visit in response to a missed doctor's appointment. Brandi Everson said she had already rescheduled her son's appointment by that point. She said the investigator seemed very concerned about the stacks of mail piled inside their home.
Two weeks later, social workers came and took Bubby away.
"There was no easy way we could control the amount of mail we were getting," said Brandi Everson. "I mean, we rented a storage unit and most of it is there. We were communicating with the CPS investigator and following all of her suggestions."
The family said the worst part of CPS' timing is that since Bubby was taken on the Friday before a holiday weekend, they have to wait until Tuesday to get any answers.
They spent the weekend cleaning their home and organizing every piece of mail.
An online petition to bring Bubby home already has more than 600 signatures. On Tuesday morning, the family has their first meeting at DSHS, and supporters plan to rally outside DSHS in Tacoma at 8:30 a.m.
The Eversons and advocates they are working with allege CPS broke Washington state law when it failed to give them a copy of the petition filed for Bubby's removal from their home.
They say they won't give up until their little boy is back home.
"We are good parents," said Brandi Everson. "And we are the ones that know how to care for our child."
KING 5 reached out to DSHS and CPS for details on why Bubby was removed from his home. Due to the Memorial Day holiday, the office was closed and our calls and emails have not yet been returned.
