The purpose of this blog has been to provide updates on some of the cases I reported in my book (Fighting CPS: Guilty Until Proven Innocent of Child Protective Services Charges ISBN 9-780-9800061-6-2) that had not been resolved when the book went to press, and to report other cases where CPS is not working up to par. I’d also like to hear about cases in which Child Protective Services did the right thing so those cases can serve as examples of what should be done. Info From TeXProtects on what happens between those every-other-year sessions of the Texas Legislature:
“During the interim, the Lieutenant Governor and Speaker of the House specify charges for respective Senate and House committees to research. These committees then hold hearings and take public testimony, resulting in reports containing their findings and recommendations. These findings and recommendations often evolve into legislation for the following Session.
“The Lt. Governor has tasked the Senate Committee on Health and Human Services with monitoring prevention services, including changes made by the 84th Legislature, and to make recommendations for any legislation needed to improve or enhance these programs.
“The House Committee on Human Services will also be examining prevention measures and resources at the Department of Family and Protective Services.
“Lastly, the Speaker has requested the House Committee on Juvenile Justice and Family Issues assess evidence-based practices around early education and parenting support, as well as the current capacity of community-based parent support programs. The committee will consider funding sources, curricula, effectiveness, systems of delivery and cost effectiveness.
“The Senate Committee on Health and Human Services will study workforce retention policy and procedures at CPS and propose solutions for improvement.
“The Senate Committee on Health and Human Services will focus on reducing recurrence of children who have experienced abuse or neglect by examining the current process that CPS uses to track recurrence of child abuse and neglect, and make recommendations to improve data tracking and the use of that data to assist in preventing recurrence. The study should examine the differences in recurrence among families who received services, families who received no services and had their cases closed, and families who had their children removed from the home.
“The Speaker has instructed the House Committee on Human Services examine the treatment of grandparents as caregivers in statute and suggest any changes that may be useful to address the growing population of such grandparents and the best interests of Texas children and families.
“Specifically, the Senate Committee on Health and Human Services will examine CPS on child safety and make recommendations for enhancing safety. It will also address children with trauma and mental illness in the state foster care system, and recommend ways to ensure children have timely access to appropriate treatment and placement options.
“The House Committee on Human Services will also research policies and procedures dedicated to eliminating child abuse and fatalities within the foster care system. In addition the committee will explore ideas and strategies to increase the number of foster families and improve the delivery of services to children with high needs.
“The Senate Committee on Health and Human Services will examine permanency and make recommendations for enhancing it. The committee will also focus on strengthening adoptions and ways to ensure a smooth transition for foster care children who are exiting the system. The Speaker has requested the House Committee on Human Services also review adoption policies, including disruptions, and make recommendations for improvements.”
And they have a BIG MESS to fix.
